Panza Privacy Policy

This “Privacy Policy” explains how [Panza Sofware Inc.] (“Company” or “we”) collects, uses, discloses, and otherwise processes personal data on behalf of our customers—typically, merchants (any, a “Merchant”)—in connection with our application, [Panza], which runs on the Clover Point of Sale system (“Clover POS”).
This Privacy Policy is intended to enable Merchants to make appropriate disclosures to their customers in the Merchant’s own privacy policy. This Privacy Policy does not apply to information collected by Clover in its capacity as a payment processor or otherwise. 1. Information We Collect
We collect the following categories of personal data on behalf of Merchants to provide the [Panza] application services:
Customer Information:
- Customer name
- Customer email address
- Customer phone number
- Customer address
- Purchase history
- Products purchased
Transaction Information:
- Clover transaction data (amount, date, time, payment method, transaction IDs)
- Tips
Business Information:
- Inventory
- Suppliers
Technical Information:
- IP address
- Clover device information
We do not collect:
- Loyalty program data
- Employee data (names, work hours, sales per employee)
- Bank details
- Credit card numbers
- Geolocation data
- Marketing/newsletter data
Note: All payment card information is processed directly by Clover. We do not store, process, or transmit payment card data.
2. How We Use Personal Data
We use the personal data we collect on behalf of Merchants for the following business purposes:
- To provide, maintain, and improve the [Panza] application.
- To facilitate transactions between Merchants and their customers.
- To manage inventory and supplier relationships.
- To respond to technical support requests.
- To comply with legal and regulatory obligations.
We will not use the personal data we collect for purposes other than as described in this Privacy Policy or as otherwise disclosed at the time of collection.
3. How We Share Personal Data
We may share personal data on behalf of Merchants with the following categories of third parties:
- Merchants: To enable them to manage their transactions, customer relationships, inventory, and suppliers.
- Clover: To process payments and ensure compliance with security standards.
- Service Providers: We may share personal data with third-party service providers that perform services on our behalf, such as hosting, technical support, or data analysis. These service providers are contractually obligated to use personal data only as necessary to perform their services.
- Legal Authorities: We may disclose personal data if required by law, such as in response to a subpoena, court order, or other legal process.
We do not sell personal data.
4. Data Subject Rights
Depending on where you reside, you may have certain rights regarding your personal data. These rights may include:

5. Data Retention
We retain personal data only as long as necessary to provide the services or to comply with legal obligations. Transaction data is retained for 7 years to comply with Canadian tax laws.
6. Security
We implement appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, or destruction. Payment data is encrypted and processed by Clover in compliance with PCI DSS standards.
7. Children’s Privacy
Our application is not directed to children under the age of 13 (or 16 in the European Economic Area). We do not knowingly collect personal data from children. If you believe we have inadvertently collected personal data from a child, please contact us immediately at [support@panza.ca].
8. Changes to This Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify Merchants and, where required by law, obtain their consent. Continued use of the [Panza] application after changes constitutes acceptance of the revised Privacy Policy.

Glossary
For purposes of this Privacy Policy:
- “App” means the [Panza] application that runs on the Clover POS system.
- “Clover” means Clover Network, Inc. and its affiliates.
- “Clover POS” means the Clover Point of Sale system.
- “Merchant” means a business that uses the [Panza] application in connection with the Clover POS system.
- “Personal Data” means any information that identifies, relates to, describes, or is capable of being associated with a particular individual.
- “Service Provider” means a third party that processes personal data on our behalf, pursuant to a contract.
