\u201cMerchant\u201d)<\/strong>\u2014in connection with our application, <strong>[Panza]<\/strong>, which runs on the Clover Point of Sale system (\u201c<strong>Clover POS<\/strong>\u201d).<\/p><p>This Privacy Policy is intended to enable Merchants to make appropriate disclosures to their customers in the Merchant\u2019s own privacy policy. <strong>This Privacy Policy does not apply to information collected by Clover in its capacity as a payment processor or otherwise.<\/strong> For information about Clover\u2019s privacy practices, please see <a Information We Collect<\/strong><\/h3><p>We collect the following categories of personal data <strong>on behalf of Merchants<\/strong> to provide the <strong>[Panza]<\/strong> application services:<\/p><ul><li><p><strong>Customer Information:<\/strong><\/p><ul><li>Customer name<\/li><li>Customer email address<\/li><li>Customer phone number<\/li><li>Customer address<\/li><li>Purchase history<\/li><li>Products purchased<\/li><\/ul><\/li><li><p><strong>Transaction Information:<\/strong><\/p><ul><li>Clover transaction data (amount, date, time, payment method, transaction IDs)<\/li><li>Tips<\/li><\/ul><\/li><li><p><strong>Business Information:<\/strong><\/p><ul><li>Inventory<\/li><li>Suppliers<\/li><\/ul><\/li><li><p><strong>Technical Information:<\/strong><\/p><ul><li>IP address<\/li><li>Clover device information<\/li><\/ul><\/li><\/ul><p><strong>We do not collect:<\/strong><\/p><ul><li>Loyalty program data<\/li><li>Employee data (names, work hours, sales per employee)<\/li><li>Bank details<\/li><li>Credit card numbers<\/li><li>Geolocation data<\/li><li>Marketing\/newsletter data<\/li><\/ul><p><strong>Note:<\/strong> All payment card information is processed directly by Clover. We do not store, process, or transmit payment card data.<\/p><hr \/><h3><strong>2. How We Use Personal Data<\/strong><\/h3><p>We use the personal data we collect <strong>on behalf of Merchants<\/strong> for the following business purposes:<\/p><ul><li>To provide, maintain, and improve the <strong>[Panza]<\/strong> application.<\/li><li>To facilitate transactions between Merchants and their customers.<\/li><li>To manage inventory and supplier relationships.<\/li><li>To respond to technical support requests.<\/li><li>To comply with legal and regulatory obligations.<\/li><\/ul><p>We will not use the personal data we collect for purposes other than as described in this Privacy Policy or as otherwise disclosed at the time of collection.<\/p><hr \/><h3><strong>3. How We Share Personal Data<\/strong><\/h3><p>We may share personal data <strong>on behalf of Merchants<\/strong> with the following categories of third parties:<\/p><ul><li><strong>Merchants:<\/strong> To enable them to manage their transactions, customer relationships, inventory, and suppliers.<\/li><li><strong>Clover:<\/strong> To process payments and ensure compliance with security standards.<\/li><li><strong>Service Providers:<\/strong> We may share personal data with third-party service providers that perform services on our behalf, such as hosting, technical support, or data analysis. These service providers are contractually obligated to use personal data only as necessary to perform their services.<\/li><li><strong>Legal Authorities:<\/strong> We may disclose personal data if required by law, such as in response to a subpoena, court order, or other legal process.<\/li><\/ul><p><strong>We do not sell personal data.<\/strong><\/p><hr \/><h3><strong>4. Data Retention<\/strong><\/h3><p>We retain personal data <strong>only as long as necessary<\/strong> to provide the services or to comply with legal obligations. Transaction data is retained for <strong>7 years<\/strong> to comply with Canadian tax laws.<\/p><hr \/><h3><strong>6. Security<\/strong><\/h3><p>We implement appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, or destruction. Payment data is encrypted and processed by Clover in compliance with PCI DSS standards.<\/p><hr \/><h3><strong>7. Children\u2019s Privacy<\/strong><\/h3><p>Our application is not directed to children under the age of 13 (or 16 in the European Economic Area). We do not knowingly collect personal data from children.
